1. Scope
These Terms of Use govern the use of the Sioly app, the digital content provided by Noah Sioly UG (haftungsbeschränkt), and access to sioly.app.
The app is distributed through the Apple App Store and Google Play. The purchase is concluded with the respective store; payment, renewal, cancellation and refunds are governed by its terms and handled there. There is no other way to buy. Purchases made through the earlier website, before the app existed, were concluded with Paddle as Merchant of Record; they remain valid, and for those the information displayed in the Paddle checkout and the Paddle Checkout Buyer Terms apply.
2. Access / Paid Content
The app is free to download from the Apple App Store and Google Play and its core functionality is usable without any purchase. Only Sioly Premium is paid — a subscription that unlocks additional modules, taken out in the App Store or on Google Play. Which modules require Premium is shown in the app before purchase. The subscription may be preceded by a free trial period. Without an active subscription or an ongoing trial the Premium modules stay locked; the rest of the app remains usable.
3. Minimum Age
Use of the app is restricted to adults (18 years or older). The app stores’ age ratings (Apple 4+, Google “Everyone”) assess the displayed content only and do not replace this contractual age limit.
We do not conduct official age verification. Age information is based on user input. If we become aware that a user does not meet the required minimum age, we are entitled to block access and deactivate the account.
If we become aware that personal data of a minor is being processed, we will delete the account in question and the associated data without undue delay. Guardians who become aware that a child is using the app may contact us at any time at support@sioly.app.
4. Accounts and Security
You are required to provide accurate information and keep your login credentials confidential. You are responsible for all activities carried out through your account.
5. AI Coach (Optional)
The AI Coach is an optional, purely software-based automated feature powered by artificial intelligence. Generated responses are not reviewed by humans.
AI-generated content may be inaccurate, incomplete, misleading, or medically incorrect ("hallucinations"). It does not constitute professional advice at any time. Use of the AI Coach does not establish any advisory, treatment, or care relationship.
Important: The AI Coach does not replace medical, psychological, therapeutic, or nutritional professional advice. Users are required to critically assess AI suggestions before implementation and consult qualified professionals where appropriate.
Emergency / Crisis: The AI Coach is not an emergency or crisis tool. If you are experiencing a mental-health emergency or have thoughts of harming yourself or others, please contact emergency services immediately (in Germany: 112) or a crisis helpline such as Telefonseelsorge (free, around the clock): 0800 111 0 111 or 0800 111 0 222. Outside Germany, please contact your local emergency number.
We assume no liability for the accuracy, timeliness, or safety of AI-generated content. Use of the AI Coach is entirely at the user's own responsibility and risk.
We reserve the right to reasonably limit use of the AI Coach (e.g., via token limits or usage caps) for reasons of system stability, abuse prevention, or fair use.
6. Health / Fitness Disclaimer
The app provides fitness, nutrition, routine, and lifestyle content for informational and motivational purposes only. Use of the app or its features does not create any advisory, treatment, care, or therapeutic relationship.
You act at your own responsibility and risk. The content does not replace medical, psychological, or physiotherapeutic advice.
Before starting any training program or dietary change (especially in cases of pre-existing medical conditions, pregnancy, or health complaints), qualified professionals should be consulted.
Cold exposure (e.g., ice baths, cold-water immersion) may involve significant health risks and can, in individual cases, be life-threatening. It is particularly unsuitable in cases of cardiovascular disease, coronary heart disease or cardiac arrhythmia, high blood pressure, pregnancy, epilepsy, or circulatory disorders (e.g., Raynaud's syndrome); do not practice it alone or without a supervising person present. Always consult a physician before each use. If you experience pain, numbness, dizziness, shortness of breath, or palpitations, discontinue immediately; in an emergency, call your local emergency number (in Germany: 112).
If pain or discomfort occurs during use, discontinue immediately and seek medical advice.
7. Usage Rights / Redistribution
All content is protected by copyright and is intended for personal use only. Redistribution, copying, public sharing, or commercial use is prohibited.
8. Misuse / Suspension
In case of violations (e.g., account sharing, redistribution of content, automated use), we may temporarily restrict or suspend access until the matter is clarified. In urgent cases (IT security or abuse), immediate action may be taken.
9. Right of Withdrawal and Refunds
For purchases made through the Apple App Store or Google Play, the respective store's terms apply to withdrawal and refunds, and such requests must be directed to Apple or Google. Should a purchase exceptionally be made through the website, the contract is concluded with Paddle (Merchant of Record), and Paddle's terms apply to withdrawal and refunds. No voluntary money-back guarantee beyond statutory rights is granted.
Early expiry of the right of withdrawal: In contracts for the provision of digital content not supplied on a tangible medium (e.g., access to the app or routines), the right of withdrawal expires prematurely pursuant to Section 356(5) of the German Civil Code (BGB) if the user has expressly agreed during the ordering process that performance of the contract begins before the withdrawal period expires and has acknowledged that they thereby lose their right of withdrawal.
10. Liability
We are fully liable in cases of intent and gross negligence as well as for injury to life, body, or health. Otherwise, liability is limited to the extent permitted under applicable law.
11. Changes / Updates and Availability
We may further develop or modify content and functions for objective reasons, provided that essential core functions are not unreasonably impaired.
We provide the updates necessary to maintain conformity and security of the app for a reasonable period of time. In the case of one-time purchases, there is no entitlement to new features beyond the original scope of purchase.
There is no entitlement to uninterrupted or indefinite availability of the app, individual functions, or the AI Coach. We are entitled to temporarily restrict or completely discontinue operation of the app or individual functions for technical, economic, or security-related reasons (e.g., maintenance, system changes, capacity limits, or discontinuation of the service).
Unless otherwise agreed, access is granted as an unlimited usage right in time, without any guarantee of permanent technical compatibility with future systems or platforms. To the extent permitted by law, no further contractual claims arise from this.
12. Account Deletion and Termination
Access to the app is provided as an auto-renewing subscription (monthly or annual) through the Apple App Store or Google Play: it renews automatically unless cancelled at least 24 hours before the end of the current period. The subscription can be managed and cancelled at any time in the respective store's account settings; cancellation stops future renewals, and access remains until the end of the period already paid for. Should a purchase instead be made through the website, access is provided as a one-time purchase granting an unlimited usage right in time (subject to Section 11).
You may delete your account at any time in the settings. Upon deletion by the user, technical access to the app and purchased content ends immediately (subject to statutory rights). Deleting your account does not automatically cancel a subscription concluded through the Apple App Store or Google Play; such a subscription must additionally be cancelled directly in the respective store to prevent further charges.
As performance is fully rendered upon provision of digital content, deletion of the account results in termination of usage rights. No (pro rata) refund claim arises in the event of deletion initiated by the user.
Restoration of deleted accounts or stored data/progress is generally not possible for technical and data protection reasons.
The provider's right to suspend or terminate for cause (see Section 8) and statutory warranty rights remain unaffected.
13. Governing Law
German law applies, subject to mandatory consumer protection provisions. Purchase-related matters are governed by Paddle as Merchant of Record for website purchases, and by the Apple App Store or Google Play for in-app purchases.
14. Community Content (User-Generated Content)
The app includes a community feature that allows users to post their own content (text, images, comments in groups and threads) and make it visible to other users.
Prohibited content: It is prohibited to post content that (a) violates applicable law, (b) glorifies or provides instructions for violence, self-harm, eating disorders, suicide, or dangerous practices, (c) contains depictions of child sexual abuse, (d) is pornographic, insulting, discriminatory, hateful, or harassing, (e) infringes the rights of third parties (in particular copyright, trademark, or personality rights), (f) contains personal data of third parties without their authorization, or (g) constitutes spam, unsolicited advertising, or automatically generated content.
Responsibility: The respective user is solely responsible for the content they post. We do not adopt user-generated content as our own.
Grant of rights: By posting content, you grant Noah Sioly UG (haftungsbeschränkt) the non-exclusive, worldwide, unlimited, royalty-free right to store, technically process (e.g., format adaptation), and display such content to other authorized users for the purpose of operating the app. This right ends upon deletion of the content or your account, unless statutory retention obligations or legitimate interests (e.g., documentation of reported violations) apply.
Reporting illegal content (Art. 16 DSA): You can report illegal content or content that violates these terms directly in the app via the reporting function on the respective item, or by email to support@sioly.app. The report should identify the content in question and the reason for the report. We review incoming reports and take the necessary measures; where possible, we inform the parties involved of significant decisions.
Moderation: We are entitled to remove reported or identified illegal or non-compliant content and to restrict or terminate use of the account concerned. We do not pre-screen all content.
Liability for third-party content: As a hosting provider, we are responsible for content posted by users only within the scope of statutory provisions (Section 10 DDG, Art. 6 of Regulation (EU) 2022/2065 – Digital Services Act). As soon as we obtain knowledge of specifically illegal content, we remove it without undue delay. Depictions of child sexual abuse are removed regardless of statutory thresholds and reported to the competent authorities.
